One of the basic principles underlying contracts, whether domestic or international, is the precise definition of the elements of the contract, especially contracts in which one of the contracting parties is obliged to fulfil a significant and substantial monetary value. Therefore, the elements of an international commercial contract must be defined in a comprehensive manner by highlighting and displaying the precise details contained in the contractual terms. Since price is the crucial point on which negotiations between the parties to an international contract tend to focus and drag on, it must be precisely determined or made determinable according to objective and legal criteria. However, what matters here is whether, when concluding an international commercial contract, the price must be determined in advance for the contract to take effect, or whether the terms of the contract can be implemented even if the price is not determined.
