، Abstract Abstract: Many countries and societies strongly believed that the end of the Cold War and the great promises and hopes of the late 1980s and early 1990s brought with them for the emergence of a more just and equitable international system, a system that saw the dissemination of the values of freedom, democracy, and human rights as a consecration of the West's victory over totalitarian regimes, and a harbinger of the dawn of a new era in which international criminal justice would be applied to individuals and groups responsible for widespread violations, such as war crimes, genocide, and ethnic cleansing. This was especially true after the establishment of international criminal tribunals to prosecute war crimes in Yugoslavia and Rwanda, and the formation of a permanent international criminal court in The Hague in 1998. However, the course of these courts and the limitation of their activities to weak and poor countries weakened the hopes placed on this project, and it became a subject of skepticism, even accusations by some, given the impotence that surrounds them when the crimes committed are attributed to major powers. This leads us to believe that impunity will remain the prevailing feature in relations between states, as evidenced by the aggression Keywords: international criminal justice, genocide, war crimes, ethnic cleansing, impunity..
