الأمن القانوني وتأثيره على النّص التّشريعي

الملخص
تُبرز هذه الورقة البحثية أهميّة الأمن القانوني وأثره على النّص التّشريعي، حيث يُعدّ الأمن القانوني عنصرًا جوهريًا في تحقيق الاستقرار والوضوح داخل المنظومة القانونية، مما يعزز ثقة الأفراد والمؤسسات بالقوانين السارية. فهو يهدف إلى ضمان معرفة الأشخاص بحقوقهم والتزاماتهم بشكل دقيق، والحدّ من الغموض أو التعديلات المفاجئة التي قد تُؤدي إلى اضطراب قانوني يمس بالمراكز القانونية للأفراد ويؤثر على استقرار المعاملات. يؤثر الأمن القانوني بشكل مباشر على جودة النّصوص التشريعية، حيث يتطلّب أن تكون القوانين واضحة ومُتسقة وخالية من التّعارض الذي قد يؤدي إلى تعدد التأويلات، كما يستلزم اعتماد منهجية تشريعية تراعي استقرار القواعد القانونية، بحيث تخضع أي تعديلات أو تحديثات لعملية مدروسة تضمن التكيف مع المُستجدات دون المساس بالحقوق المكتسبة، ممّا يسهم في تعزيز سيادة القانون وترسيخ الثقة في النظام التشريعي. This research paper highlights the importance of legal certainty and its impact on legislative texts. Legal certainty is considered a fundamental element in achieving stability and clarity within the legal system, thereby strengthening individuals' and institutions' confidence in the prevailing laws. It aims to ensure that people are fully aware of their rights and obligations, while minimizing ambiguity or sudden amendments that could lead to legal uncertainty, affect individuals' legal positions, and disrupt the stability of transactions. Legal certainty directly influences the quality of legislative texts, as it requires laws to be clear, consistent, and free from contradictions that could result in multiple interpretations. It also necessitates the adoption of a legislative methodology that considers the stability of legal rules, ensuring that any amendments or updates undergo a well-considered process that allows adaptation to new developments without infringing on acquired rights. This, in turn, contributes to strengthening the rule of law and consolidating trust in the legislative system.
