Abstract : Since its establishment under Article 152 of the 1996 Constitution, the Council of State has held a special position in the Algerian judiciary as the highest judicial authority for administrative justice. It has been assigned several important judicial tasks. This role has been reinforced through successive constitutional amendments, particularly the 2020 amendment, which redistributed judicial competencies, especially after the creation of administrative courts of appeal. This constitutional evolution was not isolated from subsequent legislative changes, the most significant of which was the passing of Law 13/22, which amended Civil and Administrative Procedure Law 09/08, alongside modifications to the relevant organic law.
