الملخص: يهدف هذا البحث إلى دراسة مفهوم "التَّبْيِين"، أو الظهور والانكشاف، كأحد طرق ثبوت الأحكام الشرعية في الفقه الإسلامي، هذا المسلك الذي يحتاج لمزيد من البحث، والدراسة، للوقوف على طبيعة المسائل التي اندرجت تحته، من حيث خصائصها، ومجالاتها، ومن هنا ، جاءت هذه الدراسة ، كخطوة إلى هذا المقصد؛ من خلال بيان مفهوم"التَّبْيِين" ، والتنظير لما يتعلق به؛ متبعا في ذلك المنهج الاستقرائي، والتحليلي، متمثلا في جمع المادة العلمية من مصادرها، ثم دراستها للتوسّل إلى مفردات هذا البحث. وتوصلت هذه الدراسة إلى جملة من النتائج أهمها: "التَّبْيِين" على لسان الفقهاء هو ظهور وانكشاف أنّ الحكم كان ثابتا في الماضي؛ أي إخبار عن الحكم لا إنشاء، وأنّ أثره يظهر في حالتين؛ عند تأخرظهور ثبوت الحكم عن زمن حدوثه، وعند انكشاف الخطأ في التقدير الي قام عيه الحكم، كما أنّ "التَّبْيِين" يرتبط بعددٍ من القواعد الأصولية والفقهية تأصيلا، وتوجيها؛ وقد خرّج الفقهاء على التَّبْيِين مسائل عديدة. . Abstract: This study aims to examine the concept of "Tabyin"—meaning clarification, manifestation, or disclosure—as one of the methods of establishing legal rulings in Islamic jurisprudence. This approach still requires further investigation and study to understand the nature of the issues it encompasses, in terms of their characteristics and areas of application. Hence, this research comes as a step toward that goal by clarifying the concept of "Tabyin" and theorizing its related aspects. The study follows both inductive and analytical methodologies, involving the collection of relevant academic material from original sources and analyzing it to extract the core elements of this research. The study has reached a number of findings, the most significant of which is: "Tabyin" in the terminology of jurists refers to the emergence or disclosure that a ruling had already been established.
