Abstract: Electronic arbitration is considered an alternative means of settling disputes imposed by technological and digital development. It is an advanced form of arbitration that does not differ much from it in terms of rules and procedures, except for its reliance on electronic media and platforms to complete these procedures. Despite the widespread demand for this type of arbitration globally, its status in Algerian law is still limited and raises many questions, as it has not directly promoted legal regulation, and no special provisions have been allocated to it. However, by referring to the rules of the Civil and Administrative Procedure Code that regulate arbitration, and given their generality, they can be applied to electronic arbitration and considered an implicit consecration of it. The Algerian legislator has also adopted several texts that can be considered an implicit consecration of electronic arbitration and are acceptable for adoption as a mechanism for settling disputes, the most important of which are: the recognition of electronic signatures in the Civil Code, the adoption of a special law on electronic signatures and ratifications, and a special law on electronic commerce. Despite this implicit and modest acknowledgment by the Algerian legislator of electronic arbitration, its activation still faces many challenges and difficulties; most notably weak infrastructure Electronic arbitration is conducted using digital platforms. In light of the weakness of the Internet in Algeria, the lack of these platforms, and the weakness of the mechanisms for providing cyber security in Algeria, it is very difficult to give it its place among other alternative methods and weakens the guarantees of acceptance by disputants in the current circumstances.
