الملخص
إن إعداد مشروع المحكمة الإفريقية لأول مرة في الدورة الثلاثين لمؤتمر رؤساء دول والحكومات المنعقد في جوان 1994. حيث تم تبني نظام الأساسي للمحكمة في 1998 بموجب المادة 01 من البرتوكول الملحق بالميثاق الإفريقي لحقوق الإنسان والشعوب. غير أنها تواجه من الناحية العملية عدة عقبات تحول دون ممارستها لدورها نتيجة لعدة اعتبارات منها ما يتعلق باليات عمل هذه المحكمة التي تخضع للإرادة السياسة لدول الاتحاد الإفريقي. the project of the African court on human rights was prepared for the thirtieth session of the assembly of heads of state and govemment held in june 1994 and the statute of the court was adopted in 1998 under article 01 of protocol to the african charter on human and peoples court. the african court on human and peoples rights faces several obstacles that prevent it from exercising its role as a result of several considerations, including those related to the working mechanisms of this courtwhich is subject to the political of the african union.
