Obstacles To Realising The Advantages Of Electronic Arbitration As A Mechanism For Resolving International Trade Disputes

Authors : Qadri Tarak .

Abstract

Abstract: The rapid expansion of e-commerce and the use of digital communications technologies has transformed traditional legal frameworks, necessitating the adaptation of arbitration procedures to the digital environment. The advantages of e-arbitration, such as speed, lower costs, and global accessibility, have emerged, but major obstacles have also emerged, including judicial uncertainty, implementation challenges, procedural concerns, and gaps in local legislation. In this context, numerous international efforts have been made, including initiatives by the European Union, the World Intellectual Property Organization, and other arbitration institutions, to establish a reliable and secure framework for the settlement of e-commerce disputes, while emphasizing the urgent need for harmonized regulations and institutional development to enhance the role of e-arbitration as a practical, effective, and trustworthy tool for settling cross-border commercial disputes in the digital age.
