The Right To A Healthy Environment: From International Recognition To Domestic Constitutionalization

Authors : Bahmed Kenza .

Abstract

The right to a healthy environment, recently recognized by the UN General Assembly, is the outcome of a gradual evolution through international and regional milestones. This development has, in turn, influenced many national legal systems, promoting the constitutionalization of this right within their constitutions, including Algeria. Since independence, Algeria’s constitutional framework has progressively evolved, with successive constitutions reflecting not only political, social, and economic transformation, but also an increasing emphasis on environmental rights. This research aims to examine the main milestones in the recognition of the right to a healthy environment at the international level and their subsequent impact on the constitutionalization of this right at the domestic level.
