The Presumption Of Innocence In Algerian Law: From Constitutional Protection To Judicial Effectiveness

Authors : Segai Afif . Djemai Leila .

Abstract

This study interrogates the presumption of innocence in Algerian criminal law as a multi-dimensional constitutional guarantee. Tracing its historical roots to current institutions, it shows the principle—enshrined in Article 41 (2020 Constitution) and buttressed by the ICCPR and African Charter—is normatively secure yet uneven in practice. While the 2025 Criminal Procedure reform (Law No. 25-14) strengthens safeguards, judicial routines still falter, especially in pretrial detention and evidentiary reasoning. Using “Guarantee” as an analytic lens, the paper maps enforcement gaps across custody, prosecutorial discretion, and adjudication, urging cultural internalization and performance-based accountability.
