الملخص
الملخص: يسلط هذا المقال الضوء على عقوبة العمل للنفع العام كأحد البدائل الحديثة التي اعتمدتها السياسات العقابية المعاصرة، في إطار السعي إلى تجديد وسائل مكافحة الجريمة وتحقيق التوازن بين حماية المجتمع وضمان حقوق الإنسان. فبدلًا من الاقتصار على العقوبات السالبة للحرية، التي ثبتت محدودية فعاليتها في بعض الحالات، خصوصًا العقوبات القصيرة المدة وما تسببه من آثار اجتماعية ونفسية سلبية على المحكوم عليهم، اتجهت العديد من الأنظمة القضائية إلى تبني عقوبة بديلة ذات طابع إصلاحي واجتماعي. وتتمثل هذه العقوبة في إلزام المحكوم عليه بالقيام بأعمال لفائدة المجتمع دون مقابل مادي، وتحت إشراف الجهات المختصة، وذلك خلال مدة محددة ووفق ضوابط قانونية دقيقة. ويُنظر إلى هذا النوع من العقوبات كوسيلة فعّالة لإعادة إدماج الجانحين في المجتمع، وتعزيز حس المسؤولية لديهم، وفي الوقت ذاته تقليل الاكتظاظ في المؤسسات العقابية، وخفض التكاليف المرتبطة بالسجن. فاعتماد عقوبة العمل للنفع العام يعكس تطور الفكر العقابي وتزايد الوعي بأهمية العقوبات الإصلاحية، التي لا تقتصر على الردع بل تسعى إلى معالجة الأسباب العميقة للانحراف. Abstract: This article sheds light on community service punishment as one of the modern alternatives adopted by contemporary penal policies, in the framework of efforts to reform crime control mechanisms and strike a balance between protecting society and safeguarding human rights. Instead of relying solely on custodial sentences—which have proven to be of limited effectiveness in certain cases, especially short-term imprisonment and its negative social and psychological consequences for offenders—many judicial systems have turned to alternative sanctions with a rehabilitative and social character. This punishment consists of requiring the convicted person to perform unpaid work for the benefit of the community, under the supervision of competent authorities, for a specified period and in accordance with strict legal regulations. This type of sanction is seen as an effective means of reintegrating offenders into society, fostering a sense of responsibility, while also helping to reduce prison overcrowding and cut down the costs associated with incarceration. The adoption of community service penalties reflects the evolution of penal thinking and the growing awareness of the importance of reform-oriented punishments, which aim not only to deter but also to address the underlying causes of delinquency.
