النظام القانوني لمقدمي خدمات الثقة الإلكترونية في التشريع الفلسطيني دراسة مقارنة

الملخص
The research addresses the concept of electronic trust service providers, their legal obligations, and the supervisory authorities overseeing their operations according to Palestinian legislation and some comparative laws. The study concluded that the approval of Palestinian Electronic Transactions Law No. 17 of 2024 is significant, as it regulates the operations of electronic service providers, electronic certification services, electronic signatures, and electronic seals. It also sets standards and procedures related to the safety of transactions and electronic records, develops the infrastructure for electronic transactions and trust services, defines the powers of the oversight authority for trust service providers, and outlines its organizational structure. Additionally, it addresses the levels of assurance in the electronic identification system and digital identity. The proposed amendment to the law reflects the Palestinian government's shift towards electronic governance and a free digital economy تناول البحث مفهوم مزودي خدمات الثقة الإلكترونية، والتزاماتهم القانونية، والجهات الرقابية على أعمالهم وفقا للتشريع الفلسطيني وبعض التشريعات المقارنة، حيث توصلت الدراسة إلى أهمية أقرار قانون المعاملات الإلكترونية الفلسطيني رقم 17لسنة 2024 لكونه نظم عمل مزودي الخدمات الإلكترونية، وشهادات المصادقة الإلكترونية، والتوقيع الإلكتروني والختم الإلكتروني، ووضع المعايير والإجراءات المتعلقة بسلامة المعاملات والسجلات الإلكترونية، وتطوير البنية الأساسية للمعاملات الإلكترونية وخدمات الثقة، وصلاحيات هيئة الإشراف لمقدمي خدمات الثقة وهيكلها التنظيمي، ومستويات الضمان منظومة التعريف الإلكترونية والهوية الرقمية، علما بأن التعديل المقترح للقانون يعد أنعاكسا لإتجاه الحكومة الفلسطينية نحو الحوكمة الإلكترونية والإقتصاد الرقمي الحر
