الملخص
ملخص: إن الدفتر العقاري باعتباره السند الرسمي ذو الحجية القانونية على ملكية العقار في الجزائر تعتبر المنازعات المتعلقة به ذات خصوصية كبيرة، وهذا يظهر من خلال تدخل المشرع الجزائري لحماية مصالح الأفراد عن طريق القضاء الذي بدوره يختص سواء في المنازعات التي تدخل في نطاق القضاء العادي أو القضاء الإداري الذي يختص إختصاصا أصيلا في المنازعات الخاصة بإصدار الدفتر العقاري وذلك كون الدفتر العقاري يعتبر قرارا إداريا الأمر الذي أكده القضاء الذي فصل في الطبيعة القانونية للدفتر العقاري. Abstract: The real estate booklet in the official bond house or the legal association on real estate ownership in Algeria considers the proceedings related to it to be of great privacy, and this appears through the intervention of the Algerian legislator to protect the interests of individuals through the judiciary, which in turn specializes whether in crises that fall within the scope of the ordinary judiciary or the administrative judiciary, which This is especially important in disputes related to the issuance of the real estate booklet, because the real estate booklet informs a higher decision, which was confirmed by the judiciary, which reaches the legal nature of the real estate registry.
