Distribution contracts are contracts born from practice and they are governed by contract law and competition law and by numerous factors such as the technical and commercial distribution conditions. In this type of contract, the parties have great freedom in drafting its content, in order to ensure good collaboration between the supplier and the distributor for an effective marketing of products and services. The termination of the fixed-term distribution contract upon the arrival of the term is only compliance with the wishes of the parties. Exceptionally, it is possible to unilaterally terminate this contract when the parties have included an automatic termination clause. concerning contracts of indefinite duration, the principle of the prohibition of perpetual commitments, which is justified in contract law by the concern to preserve individual freedom, would require that the termination of this type of contract be always possible, provided that the notice period is respected.
