أحكام الأسير وفق المنظور الحضاري الإسلامي

الملخص
ملخص : مهما تكن المعايير الدولية المتضمنة لحقوق الإنسان عموما و حقوق الأسرى على وجه التحديد، فالثابت أن الدول أثناء النزاعات والحروب لا تعطي أي وزن أو قيمة لتلك المعايير، كون الحروب لها ما يعزز و يؤزر مبرراتها العمياء ،هذا من جهة،و من جهة ثانية؛ أن الاعتبار الأكبر في تلك الظروف الاستثنائية تعطيه الدول لمصلحتها الخاصة التي تجعلها تحقق الغلبة و النصر، وفي هذا الإطار تأتي هذه المقالة لتبين وتركز على أحكام الأسرى ونظامهم العام، حسب المنظور الحضاري الإسلامي. Abstract: Regardless of the international standards that include human rights in general and the rights of prisoners of war in particular, it is evident that during conflicts and wars, countries do not give any weight or value to these standards, as wars have their own blind justifications that reinforce them. On one hand, and on the other hand, the greatest consideration during such exceptional circumstances is given by states to their own interests, which lead them to achieve dominance and victory. In this context, this article aims to explain and focus on the rulings of prisoners of war and their general system, according to the Islamic civilizational perspective.
