الإكراه على الزّنا وأثره في تطبيق الحدود

الملخص
يتمحور موضوع الدراسة حول تأثير الإكراه على إدارة المستكره وتصرفاته وأثر ذلك في تغيّر الأحكام المترتبة عليه، ذلك أنّ الإكراه سالب لإرادة المستكره وأفعاله واختياراته، فجاء موضوع البحث الموسوم بـ الإكراه على الزّنا وأثره في تطبيق الحدود، ليجيب عن إشكالية الأحكام المترتبة على فعل الزنا تحت تأثير الإكراه. ويهدف هذا البحث إلى توضيح مفهوم الإكراه على الزنا وإبراز المسؤولية المترتبة للفاعل بالإرادة والاختيار مع بيان الأحكام الشرعية في ذلك. وقد اتبعت في هذه الدراسة المنهج الوصفي التحليلي والاستقرائي وذلك من خلال معرفة الأدلة الإجمالية والتفصيلية، وتوصلت إلى أنّ الفقهاء ـ رحمهم الله ـ اختلفوا في إسقاط الحد أو تطبيقه للرجل المكره على فعل الزنا، واتفقوا على إسقاه على المرأة المكرهة. The study focuses on the impact of coercion on the coerced person's behavior and actions, and its effect on changing coercion. It emphasizes that coercion negatively impacts the coerced person's will and actions. Therefore, the research topic, "Coercion into Adultery and Its Impact on the Application of the Hudud," addresses the problem of rational judgment regarding the act of adultery under the influence of coercion. This study aims to clarify the concept of coercion into adultery and highlight the responsibilities of the perpetrator, both voluntarily and freely, while clarifying the legal ruling on this matter. In this study, I followed a descriptive, analytical, and analytical approach, examining the established and detailed evidence. I concluded that jurists-may God have mercy on them-did not agree on whether the punishment should be dropped or applied to a man coerced into committing adultery, but agreed that it should be applied to a woman coerced.
