الملخص

أدى انتشار تقنيات الذكاء الاصطناعي إلى ظهور إشكالات قانونية، خصوصًا في تحديد المسؤولية الجزائية عن الأفعال الإجرامية الناتجة عنها، فالأنظمة الذكية قد تتخذ قرارات مؤثرة دون تدخل بشري مباشر، مما يثير التساؤل حول مساءلة الأشخاص عنها. في هذا السياق، يهدف هذا المقال إلى دراسة مدى توافق الإطار التشريعي الجزائري، لاسيما قانون العقوبات، مع هذا الواقع التكنولوجي المستجد، كما يسعى إلى تحليل مدى قابلية قواعد المسؤولية الجزائية التقليدية – القائمـة علـى وجـود ركن مـادي، وركن معنوي، وشخص مسؤول – للتطبيق في سياق تكون فيه الآلة هي التي تُنتج الفعل الضار. ويخلص المقال إلى أنّ التشريع الجزائري، على غرار معظم التشريعات العربية، لا يزال يفتقر إلى نصوص صريحة تُنظم المسؤولية الجزائية في سياق الذكاء الاصطناعي، مما يفرض تحديات قانونية تتطلب تعديلات تشريعية عميقة. The widespread adoption of artificial intelligence technologies has led to complex legal challenges, particularly in determining criminal liability for offenses resulting from their use. Intelligent systems can, in some cases, make impactful decisions without direct human intervention, raising questions about holding individuals accountable for such actions. In this context, the article aims to examine the extent to which the Algerian legislative framework—especially the Penal Code—aligns with this emerging technological reality. It also seeks to analyze the applicability of traditional rules of criminal liability, which rely on the existence of a material element, a moral element, and a responsible person, in situations where the harmful act is produced by a machine. The article concludes that Algerian legislation, like most Arab legal systems, still lacks explicit provisions regulating criminal liability in the context of artificial intelligence, which poses legal challenges that require profound legislative reforms.
