تنظيم المحاكم الإدارية للاستئناف مقارنة مع المحاكم الإدارية في الجزائر

الملخص
تهدف هذه الورقة البحثية لتسليط الضوء على المحاكم الإدارية للاستئناف من خلال القانون 22/13 المعدل و المتمم لقانون الإجراءات المدنية و الإدارية إضافة إلى النصوص القانونية الأخرى ذات العلاقة؛ من حيث تشكيلتها و تنظيمها تجسيدا لمبدأ التقاضي على درجتين و ذلك بمقارنتها مع تنظيم المحاكم الإدارية وفق ذات النصوص القانونية لتتضح أكثر الفروقات بين الجهتين القضائيتين، فمن خلال ما سبق يتبين وجه التطور الذي وصل له المشرع الجزائري في سبيل بناء قضاء إداري متخصص بالمعنى الفني انطلاقا من المحاكم الإدارية و مرورا بالمحاكم الإدارية للاستئناف. حيث تم التوصل إلى نتيجة أن المشرع الجزائري في توجهه الحديث يسعى لتطبيق التخصص على القضاة عندما يصبحون في حالة الخدمة، ما يؤثر إبجابا على نوعية أحكامهم، و يرفع من مستوى خدمات مرفق القضاء بما فيه الإداري. This research paper aims to shed light on the administrative courts of appeal through Law 22/13 amending and supplementing the Code of Civil and Administrative Procedure, in addition to other relevant legal texts; in terms of their formation and organization, embodying the principle of two-level litigation, by comparing them with the organization of administrative courts according to the same legal texts, to clarify the most differences between the two judicial bodies From the above, it becomes clear what development the Algerian legislator has achieved in order to build an administrative judiciary specialized in the technical sense, starting from the administrative courts and passing through the administrative courts of appeal. The conclusion was reached that the Algerian legislator, in his modern approach, seeks to apply specialization, but in a practical manner during service, as he alone is capable of improving the quality of rulings and raising the level of services of the judicial facility in general, including adjudicating administrative disputes.
