شروط إحالة الموظف العام للتقاعد في التشريع الفلسطيني دراسة تحليلية

الملخص: يشكل التقاعد جزءًا أساسيًا من حقوق الموظف العام في الأنظمة القانونية المختلفة، وعليه يهدف هذا البحث إلى دراسة الشروط والإجراءات القانونية المتعلقة بإحالة الموظف العام إلى التقاعد وفقًا للقانون الفلسطيني، بحيث يتناول البحث تحليل النصوص القانونية الواردة قوانين الخدمة الفلسطينية وكذلك في قانون التقاعد العام، ويستعرض الإجراءات التي يجب اتباعها لضمان حقوق الموظفين والتأكد من عدالتها. تتمثل النتائج التي تم التوصل إليها في أن نظام التقاعد الفلسطيني يوفر إطارًا قانونيًا يحفظ حقوق الموظف العام، إلا أن هناك بعض النقاط التي تحتاج إلى تحسين في التطبيق العملي لضمان تحقيق العدالة في جميع الحالات، كما تم التأكيد على ضرورة تحديث وتطوير التشريعات بما يتماشى مع التحديات الحديثة لضمان استمرارية النظام وتحقيق أكبر استفادة للموظفين. Abstract: Retirement constitutes an essential part of the rights of the public employee in the different legal systems, and accordingly this research aims to study the legal conditions and procedures related to referring the public employee to retirement according to Palestinian law, so that the research deals with the analysis of the legal texts contained in the Palestinian service laws as well as in the General Retirement Law, and reviews the procedures that must be followed to guarantee the rights of employees and ensure their fairness. The results reached are that the Palestinian retirement system provides a legal framework that preserves the rights of the public employee, but there are some points that need improvement in practical application to ensure the achievement of justice in all cases, and the need to update and develop legislation in line with modern challenges was emphasized to ensure the continuity of the system and achieve the greatest benefit for employees.
