Abstract: This study aims to highlight the fundamental divergence between the rules and principles laid down by Islamic Sharia for the regulation of family relations and those imposed by civil laws, particularly in societies influenced by Western legal models. The challenge, however, does not lie solely in this divergence itself, but also in the attempts of the new world order to impose its unilateral vision on family-related issues, and in the continuous endeavor to generalize this vision across different cultures and societies, including Muslim communities, without due consideration for their profound doctrinal and cultural specificities. In this context, the present study seeks to analyze the concept of the family in Islamic Sharia from a precise legal perspective and to compare it with the provisions introduced by civil laws. The objective is to shed light on the points of convergence and divergence between the two systems, as well as to identify the major challenges faced by the Muslim family in light of the ongoing legal and legislative transformations witnessed by these societies.
