The issue of establishing legal standing (capacity) has sparked significant debate and divergence among legal scholars and the judiciary in inheritance disputes. One group within legal doctrine and jurisprudence insists on the requirement of a notarized certificate to prove such standing, regardless of the relationship between the claimant and the deceased — whether it be kinship, marriage, or lineage. They maintain that only an official document can establish one’s legal status as a rightful heir and determine the inheritance shares, asserting that standing can be proven solely through this notarized certificate. On the other hand, another group considers it sufficient to present civil status documents, such as birth certificates and death certificates, to prove one's status as an heir. This disagreement reflects a fundamental difference in understanding the nature of evidence and the requirements for admissibility of claims in inheritance disputes. It underscores the pressing need to study the issue thoroughly in order to clarify the correct framework for proving legal standing in inheritance cases — a matter that warrants in-depth research and analysis.
