The Powers Of The Sentence Enforcement Judge In The Execution Of Community Service Sentences Under Law 24-06 Amending And Supplementing The Algerian Penal Code

Abstract

Abstract: The Algerian legislator has entrusted the task of implementing the community service sentence to the sentence enforcement judge. In this regard, from the moment the case file related to this sentence is received by the public prosecutor's office until the completion of its execution, the judge is granted a range of powers intended to ensure the proper enforcement of the sentence. To this end, the judge may also undertake any action or procedure necessary to resolve issues that may arise at any stage of execution and that may hinder the achievement of the intended purpose.This study aims to define and analyze the powers of the sentence enforcement judge in the implementation of community service sentences, as the judicial authority responsible for supervising their execution. Résumé: Le législateur algérien a confié la mission de mettre en œuvre la peine du travail d’intérêt général au juge d'application des peines. A cet égard, depuis la réception du dossier relatif à cette peine par le ministère public, jusqu'à la fin de l’exécution de cette peine, il a été autorisé à disposer de nombreux pouvoirs qui garantiraient la bonne exécution de la peine. À cette fin, il peut également entreprendre toute action et procédure qui résoudrait les problèmes qui pourraient être rencontrés à n'importe quelle étape de l'exécution et qui pourraient empêcher d'atteindre l'objectif visé. ملخص: لقد أوكل المشرع الجزائري مهمة تنفيذ عقوبة العمل للنفع العام إلى قاضي تطبيق العقوبات، وفي هذا الصدد، ومنذ استلامه للملف الخاص بعقوبة العمل للنفع العام من قبل النيابة العامة، و إلى غاية الانتهاء من تنفيذ العقوبة، خول المشرع له صلاحيات عديدة من شأنها ضمان السير الحسن لتطبيق هذه العقوبة، وله في سبيل ذلك أن يتخذ أي قرار أو إجراء يراه مناسبا من شأنه حل المشاكل التي قد يواجهها في أي مرحلة من مراحل تنفيذ العقوبة والتي قد تحول دون تحقيق الهدف المنشود.
