Abstract
في إطار تجسيد الدور الإيجابي للقضاة في خصومة مدنية معروضة عليهم ن قام المشرع بسن قواعد موضوعية وإجرائية لتجسيد مبادئ تحكم مرفق القضاء ،إلا أنه خرج بقواعد غير مؤلوفة مع منطق العمل القضائي الممنهج وفق قانون الإجراءات المدنية والإدارية ،وجعل للجهات القضائية العادية وظيفة رقابية استثنائية إلى جانب دورها الأصيل معبرا عنها بنظام التصدي كآلية رقابية ضمن الهندسة الإجرائية المتخذة لكل جهة . In the context of embodying the positive role of judges in a civil dispute brought before them, the legislator has enacted objective and procedural rules to embody the principles governing the judicial facility. However, it has come up with rules that are not familiar with the logic of systematic judicial work in accordance with the Civil and Administrative Procedures Law, and has given ordinary judicial bodies an exceptional supervisory function in addition to their original role expressed in the confrontation system as a supervisory mechanism within the procedural engineering adopted for each body.
