الملخص

الملخص: تمتاز الرحلات البحرية بخاصية مواجهة الأخطار ، من بينها خطر التصادم البحري ، وهو الأكثر وقوعا في البحار، وكان محل اهتمام الفقه والقضاء الذي ساهم في توحيد جهود المجتمع الدولي في وضع معاهدات دولية حددت بموجبها مفهوم وأحكام خطر التصادم البحري . ويعتبر خطر التصادم البحري العنصر الرئيسي الذي ينشأ فيه التأمين بشكل عام والتأمين على البضاعة بشكل خاص ،والذي يساهم بشكل كبير في تطوير التجارة الدولية ،و يجسد التأمين البحري عقد التأمين البحري ،والذي تناولته التشريعات المختلفة ، والتشريع البحري الجزائري التي حددت الآليات القانونية للتأمين البحري على البضاعة من مخاطر الحوادث البحرية ، المختلفة من بينها خطر التصادم البحري، وعقد التأمين البحري والذي يكون محل وثائق التأمين البحري المتعددة . الكلمات المفتاحية: التصادم البحري- البضاعة- التأمين البحري-التشريع- وثائق التأمين- خطر. Abstract: Sea voyages are characterized by facing dangers, including the risk of marine collision, which is the most common occurrence .The seas were the focus of jurisprudence and jurisprudence, which contributed to unifying the efforts of the international community in developing international treaties that defined the concept and provisions of the risk of marine collision. The risk of marine collision is considered the main element in which insurance in general and cargo insurance in particular arises, which contributes significantly to the development of international trade. Marine insurance embodies the marine insurance contract, which has been dealt with in various legislation, and Algerian maritime legislation has defined the legal mechanisms for marine insurance on The goods are subject to various risks of marine accidents, including the risk of marine collisions, and the marine insurance contract, which is the subject of multiple marine insurance policies.
