The Legal Framework And International Mechanisms For The Protection Of The Rights Of The Child In Complex Humanitarian Contexts

Authors : Halilali Amina .

Abstract

Children with disabilities face compounded challenges resulting from the intersection of disability issues with displacement conditions, rendering their situations more fragile and complex. They often lack adequate access to essential services, foremost among them healthcare and education, while simultaneously encountering double discrimination due to their status as children with disabilities and as members of a displaced population. This dual vulnerability increases the likelihood of their exposure to violence and neglect, particularly in the context of insufficient legal protection and the absence of effective mechanisms to safeguard their rights. Furthermore, the deterioration of economic conditions imposes an additional burden on these children and their families, at a time when host countries are struggling with a shortage of programs and policies capable of addressing their specific needs. Consequently, the international protection of their rights emerges as an urgent humanitarian necessity, grounded in the enforcement of national laws and relevant United Nations mechanisms, in addition to the application of international conventions and declarations aimed at ensuring comprehensive and integrated protection of the rights of children with disabilities and the preservation of their dignity across various contexts.
