الملخص
يعد سند الشحن الإلكتروني بوجه عام عصب تداول حركة الثروات، مما يفسر الإهتمام التشريعي البالغ بتنظيم أحكامه سواء على الصعيد الدولي أوالوطني، فهو وثيقة أساسية في عملية النقل تثبت إبرام عقد النقل وأداة لتمثيل البضاعة أثناء الرحلة البحرية ودليل على إستلامها من طرف الناقل، الأمر الذي جعل المشرع البحري يبذل المزيد من الجهد للتوفيق بين إعتبارين هامين الأول ضمان تداوله، والثاني حماية أمن السند. Abstract: The electronic bill of lading is generally considered as the major factor in the wealth dynamics, which explains the immense legislative importance of its rules organization, either on the national or the international territories. It is an essential document of maritime carriage that proves, the conclusion of the contract of transport, and an instrument to represent the goods during the cruise, and as a receipt for good shipped. So, the legislator has to make more endeavors to balance between two important considerations. The first is to ensure its circulation, and the second is to protect the security of this document.
