الموت الدّماغي وتكييفه الفقهيّ

الملخص
موضوع "الموت الدماغي" من المواضع المعاصرة التي أثارت كثيرا من الخلاف واللغط بين الأطباء والفقهاء، بعد كان الموت المتفق عليه قرونا بعد قرون إلى يومنا هذا هو الموت التقليدي، وهو توقف القلب والتنفس، حتى ظهر في العقود الأخيرة مصطلح جديد للموت، وهو موت الدماغ، وكان الدافع الأساسي لظهور هذا المصطلح الجديد للموت في الغرب هو تبرير نقل وزرع الأعضاء البشرية قبل موتها بتوقف القلب والتنفس. وقد خاض الأطباء والفقهاء في التكييف الفقهي للموت الدماغي، هل هو موت حقيقي كتوقف القلب والتنفس وتترتب عليه أحكام الوفاة، أم هو احتضار وغيبوبة قبل الموت، لا تترتب عليه أحكام الوفاة إلا بتوقف القلب والتنفس، أم هناك حالة وسط وهو اعتبار حاله كحياة المذبوح تترتب عليه بعض الاحكام كنقل وزرع الأعضاء، ونتيجة البحث التي توصلت إليها أن الموت الدماغي لا يعتبر موتا حقيقيا ولا تترتب عليه أحكام الوفاة بل هو مرحلة الاحتضار التي تسبق الموت النهائي بتوفق القلب والتنفس. The theme of "brain death" is a contemporary field that has provoked a lot of controversy between doctors and jurists, after the agreed death centuries later centuries to the present is the traditional death, which is cardiac arrest and breathing, until a new term of death, namely, brain death, was driven in recent decades by the brain. The key to the emergence of this new term of death in the West is to justify the transfer and transplantation of human organs before they die with cardiac arrest and breathing. Doctors and jurists have fought in the doctrinal adaptation of brain death, is it a real death such as cardiac arrest and breathing and entails the provisions of death, or is it death and coma before death, which does not result in death except cardiac arrest and breathing, or there is a middle condition which is to consider its owner as the life of the slaughtered one sought to cause some The sentences are such as organ transplant, and the result of my research is that brain death is not a real death and does not entail the death sentences, but rather the stage of death that precedes the final death by heart and breathing.
