المفردات الفقهية في المذهب المالكي ـ حقيقتها وأقسامها وأسبابها وأهميتها وأهم المصنّفات فيها

الملخص
تناول المقال موضوع المفردات الفقهية في المذهب المالكي من حيث أقسامها وأسبابها وأهميتها وأهم المصنفات فيها؛ ومن أهم النتائج التي خلص إليها: المفردات الفقهية في المذهب المالكي يقصد بها عموما: المسائل الفقهية التي خالف فيها المذهب المالكي الراجح في المذاهب الثلاثة في مختلف أبواب الفقه الإسلامي. 2 ـ أقسام المفردات عموما؛ شرعية وغير شرعية ـ نسبة إلى الشرع ـ والمفردات الشرعية ومن أقسامها الفقهية، ومنها الفقهية في المذهب المالكي وهو مقصودنا في هذه الورقة، ومنها المفردات الفقهية في المذهب المالكي في مجال المعاملات . 3 ـ ومن الفروق بين فن الانفراد الفقهي والخلافيّات الفقهية من حيث الاتفاق كون كليهما خلافا، ومن جهة الاختلاف الخلافيّات لا تختص بمذهب معيّن، بل تشمل جميع المذاهب، بينما المفردات تختص بالمذاهب الأربعة دون غيرها. The article addressed the topic ofJurisprudential Vocabulary in the Maliki School: Its Reality, Categories, Causes, and Importance, And the Most Important Works on the Subject . Among the most important conclusions reached were: 1. Jurisprudential vocabulary in the Maliki School generally refers to juris-prudential issues in which the Maliki School differs from the prevailing opinions in the other three schools across various branches of Islamic ju-risprudence. 2. The categories of jurisprudential vocabulary are generally; Sharia-based and non-Sharia-based –relative to Sharia– and the Sharia-based jurispru-dential vocabulary includes its jurisprudential categories, among them those in the Maliki School, which sour focus in this introduction, includ-ing jurisprudential vocabulary in the Maliki school in the field of transac-tions, which is the focus of this good symposium. 3. Among the differences between the art of jurisprudential uniqueness and jurisprudential disagreements in terms of agreement is that both are disa-greements, but from the perspective of difference, the disagreements are not specific to any one school but include all schools, whereas the vocab-ularies are specific to the four schools only
