TThis study examines the legal regime governing evidentiary standards in electronic transactions against the backdrop of the ongoing information revolution. It addresses the challenges emerging from the ubiquity of Electronic Data Interchange (EDI) and the consequent rise in digital litigation, which has necessitated the adoption of modern evidentiary mechanisms. The research provides a comparative analysis of legislative trends across Arab and Western jurisdictions, with specific emphasis on the Algerian legislative stance. Crucially, the study highlights the Algerian legislature’s explicit recognition of the admissibility of electronic writing. This recognition enshrines the principle of "functional equivalence," thereby according electronic records the same probative value as traditional paper-based instruments, contingent upon rigorous safeguards regarding identity authentication and the preservation of data integrity.
