إسناد الولاية للأم- دراسة مقارنة في الفقه الإسلامي وقانون الأسرة الجزائري-

الملخص
ملخص: يهدف هذا البحث إلى تسليط الضوء على الآراء الفقهية والاختيارات القانونية لولاية الأم على أولادها القصر ، مبينا حالاتها ومشمولاتها، وصولاً إلى بيان الفروق الجوهرية بين الولاية في الفقه الإسلامي والولاية في القانون من جهة وبين ولاية الأم و ولاية الأب من جهة أخرى. وخلصت إلى أن المشرع الجزائري أعطى أهمية لولاية الأم على أولادها وفق فلسفة قائمة على محاولة التوفيق بين الآراء الفقهية من جهة ومبدأ المساواة بين الزوجين الذي أقرته الاتفاقيات الدولية التي صادقت عليها الجزائر من جهة ثانية. Abstract: This study aims to light on the jurisprudential opinions and the legal choices for Guardianship of the mother over her minor children clarifying its cases and scopes. It also seeks to highlight the fundamental differences between guardianship in Islamic jurisprudence and in law as well as between the guardianship of the mother and that of the father. This study concludes that the Algerian legislator has given importance to the mother’s guardianship over her children based on a philosophy that attempts to reconcile jurisprudential opinions in one hand and the principle of equality between spouses as established in international conventions ratified by Algeria on the other hand.
