معالم جودة الصياغة التشريعية Indicators Of Legeslative Drafting Quality

الملخص
يعرف العالم اليوم توجها عاما نحو اعتماد معايير الجودة مستفيدا في ذلك تطور الفكرة المجال الاقتصادي، اقتضى الأمر أن يكون التشريع بصفته منتوجا على درجة من الجودة، وينعكس ذلك في جودة نصوصه، باعتبار التشريع عملية مركبة تتوج بصياغة مواد قانونية تضمن تنظيم موضوع مواضيع الحياة. وهو ما أدركه المشرع والحكومة الجزائريين، فكان أن تمت دسترة مبدأ القانوني، كما تم إصدار دليل إعداد النصوص القانونية من طرف الأمانة العامة للحكومة ودليل منهجية إعداد النصوص القانونية من طرف وزارة العلاقات مع البرلمان. وفي السياق سابق الذكر يأتي هذا المقال في شكل دراسة استقرائية تحليلية تتكون من مبحثين، يتناول المبحث الأول الإحاطة بمعايير جودة الصياغة التشريعية، باعتبارها آلية لإنتاج النصوص التشريعية، في حين يتطرق المبحث الثاني إلى مبدأ الأمن القانوني باعتباره مبدأ ذو علاقة عضوية ووظيفية مع جودة الصياغة التشريعية وبينهما تأثير متبادل. ولعل أهم ما خلصت إليه الدراسة هو أن لجودة الصياغة التشريعية دورا حاسما في انتظام الحياة وحفظ الحقوق العامة والسياسية منها خاصة، وتعزيز دعائم نظام الحكم باعتباره الضامن للسير الحسن للدولة والمجتمع. The contemporary world exhibits a prevailing trend towards adopting quality standards, benefiting from the evolution of this concept within the economic sphere. This necessitates that legislation, as a product, attains a high degree of quality, reflected in the quality of its texts. Given that legislation is a complex process culminating in the formulation of legal provisions designed to regulate specific areas of life, the Algerian legislator and government have recognized this imperative. Consequently, they have constitutionally entrenched the principle of legislative quality and issued the *Guide for the Preparation of Legal Texts* by the General Secretariat of the Government, alongside the *Methodological Guide for Drafting Legal Texts* by the Ministry of Relations with Parliament. Within this context, the present article constitutes an analytical inductive study, divided into two main sections. The first section delineates the standards of quality legislative drafting as a mechanism for producing legislative texts. The second section examines the principle of legal certainty as a principle that is organically and functionally linked to the quality of legislative drafting, with a reciprocal influence between them. The study's paramount conclusion is that the quality of legislative drafting plays a decisive role in preserving societal order, safeguarding public and specifically political rights, and reinforcing the foundations of governance as the guarantor of the proper functioning of the state and society.
