الحماية القانونية للعملية الانتخابية وسؤال الفعلية The Legal Protection Of The Electoral Process And Question Of Effectiveness

الملخص

تثور النقاشات عادة حول الضمانات التي تحمي الحريات السياسية، وفي هذا السياق تجد أن دراسات كثيرة قد تمت في هذا الشأن، معالجة إشكاليات عديدة على عدة مستويات، غير أن الواقع وإشكالاته عكست مردودية ضعيفة لهذه الضمانات، وهو ما استدعى الاستشكال حول فعلية الحماية القانونية للعملية الانتخابية باعتبارها آلية من آليات تكريس الديموقراطية في الجزائر. لذلك تم العمل على تحليل هذه الإشكالية من خلال منهج تحليلي، حيث تم التطرق إلى مسألة قصور الصياغة التشريعية وأثره في العملية الانتخابية، ثم تجليات حول فعلية حمايتها من خلال أداء السلطة الوطنية المستقلة للانتخابات. تم الخلوص إلى نتيجة جوهرية تتمثل في احترام معايير جودة القانون باعتبارها ضمانة قبلية لتجسيد فعلية حماية الانتخابات، واحترام القانون وأحكام القضاء باعتبارها ضمانة مباشرة تكريس الحماية بشكل فعلي Discussions often revolve around the safeguards that protect political freedoms. In this context, numerous studies have addressed various issues on multiple levels. However, the realities and challenges on the ground have shown these safeguards to be of weak effectiveness. This has led to a critical inquiry into the effectiveness of legal protection for the electoral process as a mechanism for entrenching democracy in Algeria. Therefore, this issue was analyzed using an analytical approach. The study addressed the problem of legislative drafting deficiencies and their impact on the electoral process, followed by an examination of the effectiveness of its protection through the performance of the National Independent Election Authority. A core conclusion was reached: respecting the standards of legal quality is a preliminary safeguard for ensuring effective election protection, while respecting the law and judicial rulings serves as a direct safeguard for truly consecrating this protection
