العلاج بالخلايا الجذعية في ضوء التشريع الاماراتي والتصوير الاسلامي بين الضرورة العلاجية والضوابط القانونية

الملخص
الملخص تعتبر الخلايا الجذعية من قبل المواضيع العلمية الحديثة التي أثير حولها جدلا واسعا بين ثلة من الباحثين والأطباء والفقهاء ورجال القانون، باعتبارها تربط وجود وعدما سلامة بدن الكائن البشري، وما تشكله من راهنات علاجيه واعدة. ولذا فان الغرض من هذا البحث هو إبراز مفهوم الخلايا الجذعية في جوانبها اللغوية والإصطلاحية ثم دراسة أنواعها وكيفية إستعمالها طبيا إلى غاية التصريح على مشروعية التداوي بها على نسق من المبادئ العامة التي تضبط سلامة الإنسان لعدم المساس به جسديا وكذا عدم مخالفة النظام العام والآداب العامة. لما لا يخلو هذا الموضوع من التركيز على سلك الضوابط القانونية للعلاج بالخلايا الجذعية على ضوء التقنين الإماراتي، مصحوبا بالأحكام الفقهية لهذه النوازل الطبية ، لما يضمن لحد كبير التوازن بين الضرورة العلاجية والطموح العلمي من جهة ومرتكزات المشروعية القانونية والشرعية من ناحية أخرى Abstract : Stem cells are considered one of the modern scientific topics that have sparked widespread controversy among a group of researchers, physicians, jurists, and legal scholars, as they relate directly to the existence and integrity of the human body, and because of their promising potential in therapeutic applications Therefore, the aim of this research is to highlight the concept of stem cells from both linguistic and terminological perspectives, followed by a study of their types and medical uses, culminating in a discussion of the legitimacy of using them as a form of treatment. This is approached in accordance with general principles that ensure the physical integrity of the human being and avoid any violation of public order and morality. This topic necessarily focuses on the legal regulations governing stem cell therapy in light of Emirati legislation, accompanied by the relevant Islamic jurisprudential rulings on such medical cases. This ensures, to a large extent, a balance between therapeutic necessity and scientific ambition on the one hand, and the foundations of legal and religious legitimacy on the other.
