Public Transactions Governance Under Law N° 23-12 As A Mechanism To Protect Public Money: Case Study Of Public Transaction Concluding

Abstract

The study seeks to elucidate the governance method of public transactions by Law 23-12, where the descriptive analytical approach was relied on to delineate the governance principles, and to analyze the stages of concluding the public transactions embedded in provisions of this law, it also relied on a case study approach touched the steps for finalizing a public transaction by the Office of Real Estate Promotion and Management in Ouargla in order to analyze the reality of applying this law and highlight its effectiveness in protecting money. It was concluded that Law 23 -12 reflects good governance of public transactions because its foundation is based on the basic principles of governance, namely accountability, transparency and integrity, it was also concluded that adherence to the provisions of this law in concluding public contracts exists in real and this adherence has covered almost all loopholes of corruption, which makes this law an effective mechanism for protecting public money. تسعى هذه الدراسة إلى توضيح أسلوب حوكمة الصفقات العمومية بموجب القانون 23-12، حيث تم الاعتماد على المنهج الوصفي التحليلي لتحديد مبادئ الحوكمة وتحليل مراحل إبرام الصفقات العمومية التي تضمنتها أحكام هذا القانون، كما تم الاعتماد على منهج دراسة حالة تطرقا إلى خطوات إبرام صفقة عمومية من قبل ديوان الترقية و التسيير العقاري للتحليل واقع تطبيق هذا القانون و إبراز مدى فعاليته في حماية المال . تم التوصل إلى أن القانون 23-12 يعكس الحكامة الجيدة للصفقات العمومية لأن أساس قيامه يعتمد على مبادئ الحوكمة الأساسية والمتمثلة في المسائلة، الشفافية والنزاهة، كما تم التوصل إلى أن الالتزام بأحكام القانون 23-12 في إبرام الصفقات العمومية موجود في الواقع وهذا الالتزام غطى بالتقريب كافة ثغرات الفساد، lما يجعل من هذا القانون آلية فعالية لحماية المال العام.
