This paper, titled “The Requisites of Maqāṣid-Based Ijtihād” by Prof. Ibrahim Ali Salem Ayblou, explores a foundational issue in the theory of Maqāṣid: What conditions and prerequisites are necessary for activating ijtihād grounded in the objectives of Islamic law? The study begins with the premise that Islamic legislation is rooted in causality (ʿillah), benefit (maṣlaḥah), and wisdom (ḥikmah) in both worldly and spiritual matters, and that it is designed to achieve higher aims aligned with the overarching intent of Sharīʿah. The paper argues that a valid Maqāṣid-based ijtihād must be built upon certain requisites and operational conditions, without which juristic reasoning would become flawed and inconsistent. These requisites play a pivotal role in legal theorization, deduction, preference (tarjīḥ), and the application of rulings to real-life cases. The urgency of this inquiry is reinforced by contemporary legal challenges and evolving realities that demand a precise and principled approach to using Maqāṣid in ijtihād. The study emphasizes that neglecting these requisites leads to defective reasoning and undermines the proper function of maqāṣid in Islamic legal methodology
