الملخص
The issues surrounding Maqāṣid al-Sharīʿah (the higher objectives of Islamic law) are among the most prominent topics in contemporary Islamic thought, across its various intellectual trends and ideological backgrounds. This makes the study of the philosophy of Maqāṣid within the context of Islamic civilization—through selected contemporary models—a particularly complex endeavor. This paper offers a critical analytical perspective on the concept of Maqāṣid, by tracing the development of Maqāṣid-oriented thought and examining the contributions of several contemporary thinkers and intellectual projects that have sought to revive and expand the scope of Maqāṣid. The first section is devoted to analyzing the conceptual challenges surrounding the definitions and frameworks of Maqāṣid, particularly the ambiguity that still surrounds their meaning. The second section discusses modern claims for the renewal of Maqāṣid theory, emphasizing the urgent need to extend its application beyond the narrow boundaries of traditional jurisprudence. The third section presents selected examples of contemporary literature that approach Maqāṣid from ethical, social, political, and economic perspectives—thus revealing new horizons for the philosophy of Sharīʿah in the modern world
