الملخص: التصريح بالممتلكات آلية مستحدثة للوقاية من أعمال الفساد وقمعها ظهرت من خلال قانون الوقاية من الفساد ومكافحته رقم 06-01 المعدل والمتمم، حيث وضع ضوابط ألزم بموجبها الموظفين العمومين على التصريح بالذمة المالية في حلات وآجل معينة من أجل سد بؤر الفساد. غير أن الإخلال بأحكام التصريح ينتج عنه جرائم فساد أخرى تتمثل في عدم التصريح بالممتلكات أو التصريح الكاذب، ويصادر دور التصريح كآلية في تفادي جرائم الفساد في الإدارات والمؤسسات العمومية، لذلك وضع المشرع من التدابير منها ما يهدف إلى عدم قوع هذا الإخلال ومنها من يتدخل بعد وقوعه. Abstract: The property declaration is an updated mechanism for preventing and combating the corruption, appeared through the Law on Preventing and Combating Corruption No 06-01 as amended and supplemented, where it has established controls obliging the public employees to declare the financial disclosure in certain cases and terms to remove the corruption However, the breaching of the declaration provisions results in other corruption offences consist in the misdeclaration of assets or the false declaration, besides the role of the declaration will be confiscate as a mechanism for preventing the corruption offences in the administrations and the public institutions, that’s why the legislator sets procedures some of which aim to prevent this disruption, while others intervene after it has occurred.
