الذكاء الاصطناعي و قانون المسؤولية المدنية : نحو نظام مستقل ؟

الملخص
لما لم تكن تقنيات الذكاء الإصطناعي مجرد أداة تقنية عابرة بل ثورة رقمية، لها من الآثار ما جعلها تغير وجه الحياة ليس فقط في عصرنا هذا، بل إلى قادم السنوات. فإن التساؤل عن مدى كفاءة وصلاحية قانون المسؤولية المدنية لتغطية الأضرار الناجمة عن استخدام هذه التقنيات نظرا لتعقيداتها وخصائصها الفريدة من نوعها، قد أسال حبر الكثير من الفقهاء وأصحاب الإختصاص. ففضلا عما أظهرته القواعد التقليدية من عجز وقصور لاستيعاب مشكلات الذكاء الإصطناعي، لم تكن الحلول الأوروبية المبتكرة في هذا الصدد مرضية لحد التصديق بنجاعتها و تفعيل مضمونها لضبط الواقع الجديد، وهو الأمر الذي جعل البعض يسلط الضوء على إتباع نسق جديد في حل هذا الإشكال، بعيدا عن الإكتفاء بتكييف القواعد الحالية أو تبني فرضيات غير ناجعة، وإنما بتكريس نظام مستقل للمسؤولية عن فعل الذكاء الإصطناعي، بحثا عن تكريس مسؤولية مدنية ذكية. Since artificial intelligence technologies are not just a passing technical tool, but a digital revolution with effects that have changed the face of life, not only in our time, but in the coming years, the question of the efficiency and validity of the civil liability law to cover damages resulting from the use of these technologies due to their complexities and unique characteristics has caused the ink of many jurists and specialists to flow. In addition to what the traditional rules have shown in terms of inability and shortcomings to accommodate the problems of artificial intelligence, the innovative European solutions in this regard were not satisfactory to the point of believing in their effectiveness and activating their content to control the new reality, which is what made some shed light on following a new approach to solving this problem, far from being satisfied with adapting the current rules or adopting ineffective hypotheses, but rather by devoting an independent system of liability for the action of artificial intelligence, in search of devoting smart civil liability.
