الملخص

الاحتياط أصل يعتمد عليه الفقهاء في أحوال عديدة؛ كقيام الشبهة المعتبرة، أو الخروج من الخلاف، أو الترجيح، وما شابه ذلك، ولما كان المالكية أكثر المذاهب إعمالا لهذا الأصل، كان هذا البحث يُعنى ببيان مكانة الاحتياط عند أشهر من تقلد منصب الإفتاء بالجزائر في العصر الحديث، ألا وهو الشيخ أحمد حماني (ت1419هـ) وبمدى اعتماده عليه في فتاويه المتعلقة بالأحوال الشخصية، مُقدِّمًا للموضوع ببيان مفهوم كلٍّ من الاحتياط، والأحوال الشخصية، وذكر ترجمة مختصرة للشيخ، وقد خلصت إلى أن المنزع الاحتياطي عند الشيخ كان واضحا، فقد اعتمد عليه كثيرا في فتاويه، وبخاصة في الأحوال الشخصية، وذكرت شواهد توضح ذلك. Abstract: Reserve asset relied upon by jurists in many cases, such as the establishment of suspicion considered, or out of the dispute, or weighting, and the like, and since the Malikis more schools of thought of the realization of this origin, this research was concerned with the statement of the status of reserve when months of assuming the position of fatwa in Algeria in the modern era, namely Sheikh Ahmed Hamani (d. 1419 AH) and the extent of his reliance on it in his fatwas on personal status, in advance of the subject statement of the concept of both precaution, personal status, and mentioned a brief translation of the Sheikh, has concluded to The reserve removals of the Sheikh were clear, as he relied on it a lot in his fatwas, especially in personal status, and evidence was mentioned to illustrate this.
