السوار الالكتروني آلية رقابية وفق منظومة قضائية عصرية

الملخص
في إطار تحديث قطاع العدالة والوصول إلى تطبيقات فعلية إصلاحية، سعت الدولة الجزائرية كغيرها من التشريعات المقارنة لضم جهود رقمنة النظام القضائي وعصرنته من خلال إدراج التكنولوجيا الحديثة للإعلام والاتصال في مجال الإجراءات القضائية، لذلك قامت وزارة العدل بتجسيد هذا البرنامج على أرض الواقع، بإدراج آليات بديلة للتخفيف من العبء الذي عانت منه الهيئات القضائية وما يتعلق بها من قضايا ومتقاضين وغيرهم وصولا إلى المحكوم عليهم بعقوبة سالبة للحرية وما ينجم عنها من أثار سلبية على مستوى المؤسسات العقابية، الأمر الذي أدى لتبني فكرة السوار الالكتروني كبديل رقابي وآلية جديدة مساهمة في الدفع بالمنظومة القضائية نحو تحقيق هدف الرقي بالمحاكمة العادلة والتعزيز من حقوق الإنسان. As part of its efforts to modernize the justice sector and achieve effective reform applications, the Algerian state, like other comparative legislations, has sought to integrate efforts to digitize and modernize the judicial system by incorporating modern information and communication technology into judicial procedures. Therefore, the Ministry of Justice has implemented this program on the ground, by introducing alternative mechanisms to alleviate the burden suffered by judicial bodies and related cases, litigants, and others, including those sentenced to custodial sentences and the resulting negative effects on penal institutions. This has led to the adoption of the idea of the electronic bracelet as a supervisory alternative and a new mechanism contributing to advancing the judicial system towards achieving the goal of advancing fair trials and strengthening human rights.
