Abstract: This research paper highlights the legal and Islamic rulings related to engagement (khitbah) in both Islamic jurisprudence and Algerian family law, focusing on what is permitted and what is prohibited, in accordance with the religious and legal frameworks that govern this preliminary stage of marriage. These rules aim to preserve family ties and safeguard the rights of all parties involved. In Islamic jurisprudence, certain situations prohibit engagement, such as proposing to a woman during her waiting period (‘iddah) whether due to divorce or death, proposing to a married woman, or proposing to a woman who is already engaged without the consent of her first suitor. Engagement is also prohibited with women who are permanently or temporarily forbidden due to kinship or other legal causes. However, scholars have allowed indirect references (taʿrīd) to engagement in specific cases, such as the widow in her ‘iddah, while direct proposals remain prohibited out of respect for emotional and social considerations. In Algerian family law, these principles are reflected in legislative texts that forbid the engagement of a woman who is in her ‘iddah or already engaged. The law also recognizes the right of either party to withdraw from the engagement without legal obligation unless material or moral harm results. Moreover, engagement does not carry any legal effect unless a formal marriage contract is concluded. This paper seeks to shed light on the intersection between Islamic legal principles and Algerian statutory law, while also emphasizing the ethical and social dimensions that govern this crucial stage in the formation of the family unit.
