The Legal Approach To National Reconciliation And Criminal Legal Security In Algeria

Abstract
Abstract: In its contemporary history, Algeria has experienced years of violence and bloody terrorism, known as the Black Decade. At that time, the state faced two options: either resorting to retributive justice, which was based on accountability, or implementing restorative justice mechanisms, which were founded upon forgiveness and amnesty. It chose the latter and, for this purpose, established a National Charter for Peace and Reconciliation as a promising political and legal project. Its primary objective was to restore stability, security, and national peace, as well as to reconcile members of society with one another and with their state institutions. This endeavour relied on special legal mechanisms within an exceptional approach that transcended traditional judicial procedures. Consequently, some of these mechanisms conflict with the principle of criminal legal security in certain aspects while complementing it in others. This approach thus represented a genuine and substantial challenge for the legislature in striking a balance between the pursuit of national peace and the demands of justice. ملخص: عرفت الجزائر في تاريخها المعاصر، سنوات من العنف والإرهاب الدموي سميت بالعشرية السوداء، وقد كانت الدولة أنذاك أمام خيارين، إما اللجوء إلى العدالة العقابية التي تقوم على المحاسبة، أو إلى تطبيق آليات العدالة التصالحية التي تقوم على التسامح والعفو، فاختارت الحل الثاني، وأسست لذلك على ميثاق وطني للسلم والمصالحة مشروعا سياسيا وقانونيا واعدا، هدفه الأساس استعادة الاستقرار والأمن والسلم الوطني، وتصالح أفراد المجتمع مع بعضهم البعض ومع مؤسسات دولتهم، معتمدة في ذلك على آليات قانونية خاصة، وفق مقاربة استثنائية تجاوزت الإجراءات القضائية التقليدية، مما جعل بعض هذه الآليات تتعارض مع مبدأ الأمن القانوني الجزائي في بعض الجوانب، وتتكامل معه في بعضها الآخر، إذ شكلت هذه المقاربة تحديا حقيقيا وجوهريا للمشرع في الموازنة بين تحقيق السلم الوطني ومتطلبات العدالة.
