الضوابط القانونية للإستغلال السياحي للشواطئ كآلية للمساهمة في التنمية الإقتصادية

الملخص: تسخر الجزائر بشريط ساحلي معتبر ومهم مطل على ضفاف البحر المتوسط ونتيجة لذلك ولأهمية الموقع استراتيجيا وتاريخيا وحتى ثقافيا و سياحيا وهو معرض ورقتنا البحثية هذه نظم المشرع الجزائري عملية الإستغلال السياحي للشواطئ وفق أطر وتنظيمات وقوانين محددة وحتى أنه وفر آليات إدارية لذلك، ففي معرض بحثنا هذا تطرقنا للقوانين المؤطرة لعملية الإستغلال السياحي للشواطئ خلال موسم الإصطياف من خلال عقد الإمتياز كما تطرقنا إلى آثار هذا العقد على صاحب الإمتياز من خلال توضيح كل من حقوقه وإلتزاماته وحدود إستغلاله للشاطئ أي ما يجب عليه القيام به وما لا يجب عليه فعله على إعتبار أن الشواطئ جزئ من الأملاك الوطنية، كما بينا الهيئة الإدارية أو ما يعرف بالإدارة المانحة التي تقوم بعملية إعداد دفتر الشروط من خلال تحديد الشواطئ القابلة للإستغلال وتهيئتها قبل تنظيم إجراءات المنح؛ فإن أهمية هذا البحث توضح الطرق القانونية التي وضعها المشرع الجزائري لتمكين المستثمرين من الإستغلال السليم والقانوني والمنظم للشواطئ خلال موسم الإصطياف وإجتناب الفوضى والقضاء على عصابات الشواطئ. Abstract : Algeria boasts a significant and important coastline overlooking the Mediterranean Sea. As a result of this, and due to the strategic, historical, cultural, and touristic importance of this location, the Algerian legislator has organized the process of tourist exploitation of the beaches according to specific frameworks, regulations, and laws, and has even provided administrative mechanisms for this purpose. In this research paper, we addressed the laws governing the process of tourist exploitation of the beaches during the summer season through concession contracts. We also discussed the effects of this contract on the concessionaire by explaining their rights, obligations, and limits of beach exploitation, detailing what they must do and what they must not do, considering that the beaches are part of national property. We also clarified the administrative body, known as the granting authority, which prepares the terms of reference by identifying the beaches available for exploitation and preparing them before organizing the granting procedures. The importance of this research lies in clarifying the legal methods established by the Algerian legislator to enable investors to properly, legally, and orderly exploit the beaches during the summer season, avoid chaos, and eradicate beach gangs. This study concluded that the legislator's resort to the method of concession for organizing the process of tourism exploitation of beaches contributed to establishing a legal and regulatory framework for the process, as well as contributing to the development of beach tourism by opening the door for legitimate competition, which led to the process's development and put an end to the random exploitation of beaches, which even affected the environmental safety of these beaches.
