The increasing role of the private hospital establishment in the field of treatment and hospitalization, and by virtue of the nature of the medical works practiced there in and its seriousness has made the legislator impose very important medical obligations on it and its medical staff towards the patients dealing with it, so that it bears civil liability in the event of a breach thereof. This is what this study aims to clarify by determining the legal basis of the civil liability for medical work in the private hospital establishment, which may be based on a contract or a tortious basis, meaning without a contract in some cases.; As a result, the study concluded that despite the requirement of error in establishing this responsibility, the damage is its essence and basic element, such that it results in an inevitable result regardless of the existence of a contract or not, which is compensation for the patient for the damage he suffered as a result of medical work in these establishments.
