تفاقم قدر الضرر وتعويضه في المسؤولية المدنية

الملخص
يتمثل هدف المسؤولية المدنية في جبر الضرر وتعويض المضرور تعويضا كاملا، ولا تثار صعوبة في تقديره إذا كان ثابتا فيقدر وقت الحكم، إلا أنه قد ترد تغيرات على عناصره الذاتية فيتفاقم في قدره بسبب التطورات المتوقعة وغير المتوقعة، وإذا كانت القاعدة تقضي بأن يعتد القاضي عند الحكم بكل تفاقم يرجع إلى المسؤول، فإنها تقضي بحق المضرور بتعويض تكميلي عن هذا التفاقم ولو لم يحفظ له الحكم بذلك. The objective of civil liability is to redress the damage and fully compensate the injured party. Assessing the damage is not difficult if it is fixed and estimated at the time of judgment. However, its inherent elements may change, and its value may increase due to both expected and unforeseen developments. While the rule requires the judge to consider, when ruling, any aggravation attributable to the responsible party, it also entitles the injured party to supplementary compensation for this aggravation, even if the judgment does not reserve its right.
