مدي استقلال جريمة الاتجار بالأعضاء البشرية عن جريمة الاتجار بالبشر

الملخص

تصنف المافيا المغاربية الثالثة عالميا في مجال جريمة الاتجار بالأعضاء البشرية، حيث وجب تجريمها بأركان خاصة ضمن نصوص عقابية مستقلة عن تلك التي تجرم أشكال الاتجار بالبشر وذلك على المستويين الدولي والمغاربي. يتضح من خلال ما تم دراسته أن فقط الجزائر والمغرب من اعتمدت ذلك، بينما اكتفى المشرع التونسي على اعتبارها صورة من صور الاتجار بالبشر لا أكثر. تبعا لذلك أقترح في هذا الصدد وجوب تجريم هذه الظاهرة من خلال تقنين أحكام عقابية خاصة بها من طرف المشرع التونسي من جهة، ومن جهة أخرى، العمل على توحيد النصوص العقابية المجرمة للاتجار بالأعضاء البشرية بين تشريعات المغرب الكبير. The Maghreb Mafia is ranked third in the world in the field of the crime of trafficking in human organs, as it must be criminalized under special elements within penal texts independent of those that criminalize forms of human trafficking at the international and Maghreb levels. It is clear from what was studied that only Algeria and Morocco adopted this, while the Tunisian legislator contented itself with considering it a form of human trafficking and nothing more. Accordingly, I suggest in this regard that the phenomenon should be criminalized by codifying its own punitive provisions by the Tunisian legislator on the one hand. On the other hand, working to unify the penal provisions criminalizing human organ trafficking among the legislation of the Maghreb. Keywords: Human trafficking,trafficking in human organs, the Maghreb.... La mafia maghrébine se classe au troisième rang mondial en matière de criminalité liée au trafic d'organes humains. Elle doit être criminalisée avec des éléments particuliers dans les textes pénaux, indépendants de ceux qui criminalisent les formes de traite des êtres humains, aux niveaux international et maghrébin. Il ressort de ce qui a été étudié que seuls l'Algérie et le Maroc l'ont adopté, alors que le législateur tunisien s'est contenté de le considérer comme une forme de traite des êtres humains et rien de plus. En conséquence, je suggère à cet égard que le phénomène soit criminalisé en codifiant le sien des dispositions punitives du législateur tunisien d'une part, d'autre part, œuvrer à unifier les dispositions pénales incriminant le trafic d'organes humains parmi les législations du Maghreb.
