تفعيل الحماية القانونية الوطنية للثروة المائية في مواجهة تغيرات المناخ

الملخص
أصبح الماء حديثا يأخذ أبعاد قانونية أكثر من أبعاده السياسية والاقتصادية، وقد أولته الدول أهمية كبيرة _على غرار الجزائر_ كونه مورد هام ليس في التنمية فحسب، بل أصبح المورد الطبيعي الذي يمنح الحياة للكائنات الحية ككل، لذلك فهو يرتبط ارتباطا وثيقا بالأمن الغذائي للدولة، وفي بعض الأحيان مصدرا للصراعات والنزاعات الدولية كالذي يحدث بين دولة مصر واثيوبيا. ذلك أن الثروة المائية بالنسبة للدول مسألة حياة أو فناء ومن أجل تأمين هذه الثروة عملت الدول على بناء سياسة استراتيجية مستدامة، يتم تنفيذها باستثمارات وتجهيزات ضخمة قد لا تكفي في ظل الاستعمال الواسع لها، لذلك نجد الدولة تفرض حماية قانونية على هذه الثروة لترشيد استعمالها واستغلالها في ظل التغيرات المناخية التي تتأثر بها سلبا وايجابا. وتأتي هذه الدراسة للوقوف على الاستراتيجية التشريعية التي قامت بها الدولة الجزائرية في سبيل تنفيذ وتطبيق سياستها في مجال حماية الثروة المائية. الكلمات المفتاحية: الثروة المائية؛ تغيرات المناخ؛ الحماية القانونية للثروة المائية. Abstract: Water has recently taken on more legal dimensions than its political and economic ones, and states have given it significant importance, similar to Algeria, as it is a crucial resource not only for development but also as the natural resource that sustains life for all living beings. Therefore, it is closely linked to a state's food security and, at times, a source of international conflicts and disputes, such as the one occurring between Egypt and Ethiopia. For states, water resources are a matter of life or extinction, and to secure these resources, countries have developed sustainable strategic policies, implemented through massive investments and infrastructures that may not be sufficient given their extensive use. Hence, states impose legal protection on these resources to rationalize their use and exploitation in the face of climate changes that affect them both negatively and positively. This study aims to examine the legislative strategy undertaken by the Algerian state to implement and apply its policy in the field of water resources protection.
