Electronic Risks To Rights And Freedoms (the Right To Privacy As A Modele)

Abstract
The digital revolution of the late 20th century, while bringing unprecedented connectivity and information sharing, has created significant challenges for constitutional rights and freedoms, with privacy rights being particularly vulnerable to technological advancement. As digital communications evolve, traditional privacy concepts face mounting pressure from mass surveillance, data breaches, unauthorized tracking, and personal information commodification, necessitating a comprehensive examination of technology's impact on privacy rights and their legal protections. Addressing these challenges requires a multi-layered approach that combines updated legislative frameworks, robust technological safeguards, effective regulatory oversight, and privacy-by-design principles in technology development. This coordinated effort from lawmakers, technologists, and civil society is crucial for preserving individual privacy while embracing digital advancement, ultimately maintaining human dignity and personal autonomy in an increasingly connected world. أحدثت الثورة الرقمية في أواخر القرن العشرين تحولًا كبيرًا في عالم الاتصال وتبادل المعلومات، لكنها في الوقت نفسه خلقت تحديات جسيمة للحقوق والحريات الدستورية، حيث أصبحت خصوصية الأفراد معرضة بشكل خاص للتأثر بالتطورات التكنولوجية، ومع تطور الاتصالات الرقمية تواجه المفاهيم التقليدية للخصوصية ضغوطًا متزايدة من جراء المراقبة الجماعية، انتهاكات البيانات، التتبع غير المصرح به، وتحويل المعلومات الشخصية إلى سلعة تجارية. وهذا يستدعي دراسة شاملة لتأثير التكنولوجيا على حقوق الخصوصية والحماية القانونية المقدمة لها. ويتطلب التصدي لهذه العديد من التحديات تجمع بين تحديث الأطر التشريعية، ضمانات تكنولوجية فعالة، ورقابة تنظيمية، ومراعاة مبادئ تصميم التكنولوجيا مع مراعاة الخصوصية منذ البداية. إن هذا الجهد المنسق من المشرعين، التقنيين، والمجتمع المدني ضروري للحفاظ على خصوصية الأفراد مع تبني التقدم الرقمي، مما يساهم في الحفاظ على الكرامة الإنسانية والاستقلالية الشخصية في عالم يزداد اتصالًا.
