سلطة حلول الوالي في نطاق نشاط هيئتي البلدية ( رئيس المجلس الشعبي البلدي-المجلس الشعبي البلدي

الملخص
يعتبر حلول الوالي بديلا لرئيس المجلس الشعبي البلدي إجراءا استثنائيا ينظمه القانون لضمان استمرارية تسيير شؤون البلدية في حالات محددة حصرا بموجب القانون . وهذا راجع لظروف تعيق الرئيس عن أداء مهامه المسندة إلية ، وعليه، ووفقا للنصوص القانونية فقد نظمت هذا الإجراء وذلك عن طريق حلول الوالي بصفة مؤقتة ليتولى إدارة البلدية وهذا بهدف ضمان استمرارية تقديم الخدمات العامة وتجنب الوقوع في الفراغ الإداري . حيث يلتزم الوالي بتطبيق القوانين المحلية وتنفيذ القرارات التي تضمن حسن سير المرفق البلدي . ويعود الهدف من تكريس هذا الإجراء إلى الحفاظ على استقرار الهيئات المحلية ، لكن يتطلب عند تجسيده الحذر لأنه من أخطر آليات الرقابة الوصائية على الجماعة المحلية لكي لا يؤثر على استقلالية المرفق البلدي في تكريس مهامه المنصوص عليها قانونا . The replacement of the Mayor of the Municipal People’s Council by the Governor is an exceptional procedure regulated by law to ensure the continuity of municipal affairs management in specific cases exlusively stipulated by law . This occurs due to circumstances preventing the Mayor From performing the duties assigned to him. Consequently, according to legal provisions , this procedure is organized by temporarily assigning The Governor to manage the municipality . The purpose is to ensure the continued delivery of public sevices and to avoid any administrative vacuum . The governor is required to apply local laws and implement decisions that guarantee the proper functioning of municipal services.The primary aim of this procedure is to preserve the stability of local institutions . However , careful application is necessary, as it is one of the most critical mechanisms of supervisory control over local communities , and it must not undermine the autonomy of the municipal administration in carrying out its legally mandated duties.
