الملخص

الملخص: يعتبر النظام العام من الاعمدة الأساسية التي يقوم عليها القضاء الإداري الجزائري، لاسيما ما تعلق بالجوانب الإجرائية، لا سيما و أن هذه القواعد الإجرائية تهدف إلى توفير الحماية القضائية للحقوق الأساسية الموضوعية، ويكون ذلك بتنظيم المبدأ الأساسي في التقاضي، وهو الحق في اللجوء إلى القضاء عن طريق تحديد الجهات القضائية المختصة، ثم تحديد الإجراءات التي يتطلبها القضاء في الفصل في النزاعات المعروضة أمامه بداية من رفع الدعوى، وتحريكها، وسير الخصومة إلى صدور الاحكام وتنفيذها. وفكرة النظام العام لها فعالية كبيرة اثناء سير الدعوى والفصل فيها، فهي قيد قانوني وضعه المشرع حتى يضمن سير العدالة، حتى لا يتعسف القضاة، أو يحيدوا عن قواعد العدالة، ومن جهة أخرى يضمن للمتقاضي محاكمة عادلة عن طريق ارتباط النظام العام بالقواعد الآمرة التي لا يجوز خرقها أو الاتفاق على مخالفتها، ويؤدي الخروج عنها وخرقها إلى البطلان المطلق. Abstract: Public order is considered one of the basic pillars on which the Algerian administrative judiciary is based, especially with regard to procedural aspects, especially since these procedural rules aim to provide judicial protection for substantive fundamental rights, and this is to organize the basic principle of litigation, which is the right to resort to the judiciary by determining the competent judicial authorities, and then determining the procedures required by the judiciary to adjudicate the disputes submitted to it, starting with the filing of the lawsuit, moving it, and the course of the adversary to the issuance and execution of judgments. The idea of public order is very effective during the conduct and adjudication of the case. It is a legal restriction developed by the legislator to ensure the course of justice, so that judges do not be arbitrary, or deviate from the rules of justice. On the other hand, the litigant is guaranteed a fair trial by linking public order to the peremptory rules that may not be violated or agreed to violate, and departing from them and violating them leads to absolute invalidity.
